I went to misdemeanor court in Riverside today with AnonOrange and Graham Berry. On the other side were cult attorney Elliot Abelson, Murial Dufresne and Dan Dunigan, the guy who accused AO of hitting him.

Basically the arrignment was put off until January and the trial until March. Abelson wanted to ban Orange from all cult properties. The judge said "no he is only banned from gold."  Graham said Abelson looked pretty bad. "They make him run everywhere and he's old" Graham said.

Meanwhile Orange has examined the land records of Gold Base. It seems there is a 50 foot easement on both sides of the street. How could the fence be so close? Because the cult built the fence on PUBLIC property. Apparently, when the govt told them to move the fence they said "can't we just move our property line?"  According to Smurf they even tried to have the road through the complex removed.  In other words, the property line is farther back than it looks. Additionally, "no trespassing" signs need to be a certain size to be legal and the cult's weren't. They added a sign since the incident but seem to be claiming it was there all along.

While I don't agree with everything AO says or the tinfoily way he thinks at times, I hope like hell he prevails on this.  He may be a flake and a little nuts, but his heart's in the right place.

And a win here would be epic for all the critics.

Definitely! With Elliot Abselson defending the cult. He was a mob lawyer for the Gambino crime family (John Gotti?) before he became a ho for the cult.

Bringing in Abelson is probably a step up from Moxon.  Moxon is their general guy.  Abelson is one of the heavy hitters they bring in for important stuff, it seems.  Graham calls him a "Mob Lawyer", but really he just defended some mob pornographers back in the 70s who were charged with shipping porn across state lines.  He used to be an assistant DA in Los Angeles, apparently before he went into private practice.

They seem to do this as a matter to course...just to drag things along and force people to work their real lives around a court schedule.

Interesting.

So basically, the cult is illegally on public land with its razor wire fences? My, wouldn't that be a clusterfuck if some citizen got hurt by getting accidentally slashed by those sharp, pointy bits of metal strung on the inside of the fence. Like say, you sort of tripped, put your hand out and...

Or, say that Riverside County is well aware of this, and has kept it quiet all these years. Perhaps that is why the sheriff's department is so rabid and neglectful of its charge to keep the public trust.

Pictures will prove that there was a lack of signage on that vacant lot. I have pictures dating back a decade that will show the lot in the same condition as it was the day in question. And one sign is not sufficient. They have to be a certain size, number, and distance apart. And they have to be on the boundary of the property in question.

Can we fire up the people of Riverside to demand the cult get its fat ass off public land? There is a law regarding easements on private property, if a piece of private property has been used as a thoroughfare for a certain period of time, the owner can no longer lay claim to it. I don't think that applies to public land, but it'd be worth looking into.

What are the penalties for illegally occupying public land? And where did the assault take place? Inside or outside cult property?

Apparently they've decided to go ahead and press charges. But, if the assault on AO happened on public land, why would they? Take away the trespassing charge, and what you're left with is assault by the Scientology goon squad and self defense on the part of AO.

I remember when they tried to get the highway through Gold Base shut down. A tentative move on the cult's part involved some lie about wanting to "film the night sky from the middle of the highway." For a month! Motorists who use that highway to get to the I-10 were not happy. The detour was a total clusterfuck. Caltrans reopened the road in a week due to all the complaints from angry motorists.

Who was responsible for this stupid approval? We were never able to find out. Richard Maggini tried, and got the runaround from Caltrans. The stupid thing is, there is a lot of land at Gold from which the night sky could be filmed. They didn't need to film from the highway, and probably didn't. It was only a probe to see how viable that closure would be.

Was any reason given for the postponement of AO's arraignment? I mean, it's a bloody simple procedure. Defendant pleads guilty or not guilty. It ain't rocket science.

Just to corroborate what Pope is saying, we got this from the Riverside Planning department:

Planning Case #: LLA03613 Description: Adjust Lot Line to Accommodate Existing chinback fence adjust lot lines.  Status as of 11/21/2008: TENTAPPR.  (Tentatively Approved)

For those in the area, please ask the planning commission to deny this request.  If their fence is on public property, it needs to be moved back.  We have engineering drawings from the company that was contracted for Gold Base dating back to 1987 clearly showing the easements/right of way.  They knew where the property lines and they violated them.
